General Terms of Use for Arkada Studio Mobile Applications
This English version is provided for information purposes only. In the event of any discrepancy, the French version prevails.

Definitions
Application: any mobile application published by Arkada Studio.
User or Player: any person who downloads and uses the Application for private, family, or personal purposes.
Services: all of the features offered by the Application.
Account: personal space allowing access to the Services that may be linked to an Arkada product.
Article 1. Purpose
The purpose of these general terms of use is to govern access to and use of the Applications and Services published by Arkada Studio.
Article 2. Scope and acceptance
Use of the Application implies full and complete acceptance of these Terms of Use. Arkada Studio may update them at any time. The applicable version is the one accessible in the Application or on the publisher's website on the date of use.
Language – Versions. These Terms of Use may be translated. In the event of any discrepancy, the French version prevails. Successive versions of these Terms of Use are archived by Arkada Studio; the User may obtain a copy upon reasonable request.
Article 2 bis. Intended audience – Minors
The Applications are intended for a consumer audience. Their use by a minor is placed under the supervision and responsibility of the minor's legal representative. The User warrants that they are of an age to accept these Terms of Use under applicable law and the rules of the applicable stores and, where relevant, that they have the required parental authorization.
Health warning (photosensitivity): certain visual or audio sequences may not be suitable for people prone to photosensitivity disorders. The User is invited to follow the usual safety recommendations for video games (regular breaks, suitable brightness, and so on).
The age ratings displayed on the App Store (for example 4+, 9+, 12+, 17+) and on Google Play (IARC/PEGI system) constitute minimum references. Arkada Studio ensures alignment between these ratings, this "Intended audience – Minors" clause, and the Privacy Policy.
In the event of any discrepancy, Arkada Studio makes the necessary adjustments (texts or store declarations) to restore consistency.
Article 2 ter. Platform terms – License of use
The User acknowledges that access to the Applications distributed through the Apple App Store and Google Play requires compliance with the terms applicable to these platforms.
– Apple App Store: in the absence of a specific license agreement provided by Arkada Studio, the "Licensed Application End User License Agreement" (Apple's standard EULA) applies to the download and use of the Application.
– Google Play: the User undertakes to comply with the Google Play rules applicable to content and to the use of applications.
In the event of a contradiction between these Terms of Use and the mandatory terms of the platforms, the latter prevail on points relating strictly to distribution and use through the platform concerned.
Article 3. Access and download
The Applications are available on the official Apple App Store and Google Play stores. Downloading is free. Access to certain Services may require the creation of an Account and the activation of a physical Arkada product. The User makes sure to have a compatible device and an Internet connection for the download and, where relevant, for activation or initial synchronization.
Article 4. General requirements
The User must have a compatible mobile device, a supported operating system, sufficient storage space and, where relevant, an Internet connection for the steps that require one. Additional requirements specific to a game may apply and are set out in the relevant Game Annex.
Article 5. User account
The creation of an Account may be necessary to access the Services. The User enters a username, a password, and an email address, and warrants the accuracy of the information provided. The User is solely responsible for keeping their credentials confidential and for any action carried out through their Account. In the event of unauthorized use, loss, or theft of credentials, the User informs Arkada Studio without delay at support@arkada.fr in order to obtain a reset.
The User undertakes to choose a strong password and not to share it. Where available, two-factor authentication (2FA) is recommended. Arkada Studio may require credentials to be changed in the event of a proven security risk. Account sharing (multiple simultaneous users) is prohibited unless stated otherwise in the Game Annex.
Article 5 bis. Accounts per Application
At this stage, each Arkada Application requires the creation of a separate Account. The User may use the same email address from one Application to another, but Accounts are not interconnected and data is not shared between Applications, unless stated otherwise in the Game Annex or the Privacy Policy.
Article 6. Activation and link with an Arkada product
Access to certain content may require the activation of a game box or an Arkada product by means of a mechanism provided for this purpose, for example a QR code or an activation code. The precise terms are set out in the Game Annex.
Article 7. Features
The features offered by the Application are described in the corresponding Game Annex. Arkada Studio may add to, modify, or withdraw features, in particular for technical, security, game-balance, or compliance reasons.
Arkada Studio may adapt, suspend, or withdraw all or part of the Services on legitimate grounds (security, compliance, technical constraints, game balance, third-party rights). In the event of the permanent discontinuation of an Application or of a major feature, Arkada Studio will endeavor to inform Users in advance by an appropriate means within a reasonable time.
Article 7 bis. Third-party services and interoperability
The Application may offer links or technical integrations with third-party services (for example official campaign sites, support pages, stores, community platforms). Use of these services is subject to the terms and policies of their publishers. Arkada Studio is not responsible for the content, availability, or security of these third-party services.
If the User chooses to access them with their Arkada account, the rules for sharing the information necessary for authentication are those described in Article 5 bis and in the Privacy Policy.
Article 8. Updates, availability, and maintenance
Arkada Studio makes reasonable efforts to ensure that the Applications are accessible. Access may be suspended for maintenance, updates, changes to the Services, events outside its control, or force majeure. Installing updates may be necessary for reasons of security, compatibility, or proper operation.
Hosting and external providers. The information collected and processed through the Application may be processed and/or hosted by external providers. Arkada Studio cannot be held liable for unavailability caused in particular by force majeure, maintenance, an update, a modification, action by a subcontractor or by the device manufacturer, an internal or external strike, a network failure, or incorrect configuration or use of the device by the User.
Article 8 bis. Suspension or permanent discontinuation of the Service
Arkada Studio reserves the right to suspend or discontinue any online Service (servers, APIs, infrastructure necessary for the games to operate).
Users will be given a minimum of 60 days' notice, by email and/or notification in the Application, before any permanent shutdown, except in cases of force majeure or legal obligation.
In that case, Arkada Studio undertakes:
– to make the game playable offline as far as possible, even with limited features;
– to provide the source code and/or the necessary resources under an open-source license (AGPL v3), excluding third-party items under a commercial or non-transferable license;
– to inform Users clearly of the feature limitations applicable in the offline version.
The published source code is provided without warranty and without any obligation of support, maintenance, or updates. Any use, modification, or redistribution of the code must fully comply with the terms of the AGPL v3 license.
Article 9. Intellectual property
The Applications, Services, content, graphic elements, texts, images, sounds, videos, databases, and software are protected by applicable law and remain the exclusive property of Arkada Studio and its rights holders.
In particular, the User is prohibited, for any reason whatsoever, from:
– Accessing, attempting to access, copying, or using the source code of the Application;
– Using the Application for purposes other than access to the Services;
– Impersonating a natural person or legal entity;
– Copying, modifying, correcting, adapting, hosting, extracting, reusing, distributing, or commercially exploiting the Application, the Services, or their content without the prior written authorization of Arkada Studio;
– Incorporating the Application into other software or creating derivative works based on the Application, by any means or on any medium;
– Disclosing their account information to third parties;
– Selling, renting, sublicensing, or distributing the Application and/or its content to third parties in any way whatsoever;
– Exporting the Application or merging all or part of it with other computer programs;
– Extracting or reusing, including for private purposes and without prior written authorization, a substantial or insubstantial part of the content of the databases and archives created by the Application;
– Attempting to harm or destroy the Application, or to hack the Application and/or its content in whole or in part;
– Using a data collection system or any other process for obtaining and extracting data in connection with the Application or the Services.
Credits and third-party components
The Applications may include third-party libraries or components (including open-source ones). The list and the associated licenses are accessible in the Application (Credits / Licenses section) and/or on the Arkada Studio website (Credits page). The User undertakes to comply with the terms of these third-party licenses.
Article 9 bis. User content (UGC) and moderation
Where the Application allows content to be included, transmitted, or generated (for example audio items, texts, images):
– the User remains the owner of the rights to their content;
– the User grants Arkada Studio, for the legal term and worldwide, a non-exclusive and royalty-free license to reproduce, display, adapt, store, and communicate the content to the public, strictly for the purposes of providing, operating, securing, correcting, and improving the Services;
– the User warrants that they hold all necessary rights and authorizations and undertakes not to submit any content that is unlawful, infringing, harmful to the rights of third parties, or contrary to public order;
– Arkada Studio may remove or disable any content reported as unlawful or contrary to these Terms of Use and suspend the Account in the event of repeated abuse.
A reporting mechanism is accessible from the Application (see Game Annex).
Article 10. Prohibited conduct
The User undertakes in particular not to impersonate a third party, not to infringe the rights of others, not to use automated data collection systems, not to disrupt or attempt to disrupt the proper operation of the Applications, not to introduce viruses or malicious code, and not to circumvent technical protection mechanisms.
The User undertakes to comply with applicable export regulations and international sanctions and not to use the Applications in countries, or for the benefit of entities or persons, subject to legal restrictions.
In the event of fraud, spam, abuse, or misuse of the Services (for example abusive exploitation of the activation mechanisms), Arkada Studio reserves the right to temporarily suspend the Account concerned. Access may be restored after verification and discussion with support, except in cases of serious repeat offenses, where a permanent ban may be applied.
Abuse detection.
Arkada Studio implements mechanisms to detect automated, fraudulent, or abusive activity (in particular anti-bot measures and protection of APIs and activation mechanisms). In the event of serious or repeated anomalies, Arkada Studio may temporarily limit certain features, suspend the Account and, in the event of repeat offenses, proceed with permanent closure, in accordance with Article 13.
Article 11. Liability
The User uses the Services at their sole responsibility. Arkada Studio cannot be held liable for indirect or intangible damages or for the consequences of any use of the Applications that does not comply with these Terms of Use. The User is responsible for the compatibility and good working order of their device and connection. Arkada Studio is not responsible for failures of telecommunications networks or of third-party technical providers.
Article 12. Personal data
The processing of personal data is governed by the Arkada Studio Privacy Policy, accessible in the Application and on the publisher's website. That policy sets out the categories of data, purposes, legal bases, retention periods, rights of individuals, and GDPR contact details. Any differences between games are specified in a table or in a section dedicated to each game.
The Applications may include certain third-party SDKs that are strictly necessary for proper operation, in particular:
– Diagnostics (Android). The Applications may include Google Analytics for Firebase strictly in diagnostics/stability mode (anonymized collection of device type, system version, and nature of the crash). No advertising SDK and no marketing profiling.
– Voice recognition (Erune, Spark Riders 3000). Activation of the microphone is entirely optional and is based on the User's explicit consent. The transcription and analysis of voice commands are carried out using technical providers described in the Privacy Policy. Voice data is not retained beyond the time necessary for processing, and processing is carried out in European regions where technically possible.
Article 12 bis. Usage measurement and SDKs
The Applications include no advertising or marketing profiling SDK.
Only minimal technical data, strictly necessary for proper operation (for example local error logs, stabilization), may be generated.
Erune and Spark Riders 3000 include a voice recognition feature subject to the User's explicit consent. Processing is carried out with providers located in the European Economic Area or in the United Kingdom (which benefits from an adequacy decision) and, where relevant, governed by Standard Contractual Clauses where the regulations require it. Salami (Sifflard) does not transfer any data outside the EEA.
Article 12 ter. Contributor credits and display of first names
Certain Applications display, in a credits screen, the list of people who supported an Arkada game through a crowdfunding platform (in particular Kickstarter, Gamefound, and Gameontabletop).

Data displayed
The following data may be displayed in the Application's public credits: either the first name and the first letter of the last name; or the public username chosen on the crowdfunding platform.
Under no circumstances are full names taken from payment data, email addresses, or other billing or contact data displayed in the Application. -
Origin of the data and legal basis
First names, initials, and usernames come exclusively from the public information entered by the contributor on the crowdfunding platform.
The legal basis for the processing is Arkada Studio's legitimate interest in identifying and publicly thanking the project's contributors; and, where the platform provides for it, the consent given by the contributor to the display of that name or username in the game credits. -
Right to object, to modify, and to erase
Any person whose first name, last-name initial, or username appears in the credits may at any time request a change to the wording used; or the removal of any mention concerning them.
Requests are made in writing to the following address: support@arkada.fr. Arkada Studio will endeavor to respond as quickly as possible and, in the event of a removal request, to remove the mention concerned in a forthcoming Application update reasonably close in time. -
Notice in the Application
A visible notice is included in the credits screen, along the following lines: "The first names displayed come from the public usernames entered on the Gamefound, Kickstarter, and Game On Tabletop crowdfunding platforms. For any change or removal request, contact: support@arkada.fr."
Article 13. Account management
Creation and modification: carried out by the User in the Application.
Suspension: in the event of noncompliance with these Terms of Use, fraudulent use, or infringement of the rights of Arkada Studio or of a third party, Arkada Studio may suspend access to the Account and to the Services.
Inactivity: an Account inactive for 18 months may be deactivated.
Deletion: when a User requests the deletion of their Account, Arkada Studio proceeds with immediate deactivation ("soft delete"). If the User does not log back in within 30 days, the Account and all associated data (including game saves) are permanently deleted. This deletion is irreversible.
Graduated sanctions. In the event of fraud, abuse, or serious breach of these Terms of Use, Arkada Studio may apply a temporary suspension with review by support. In the event of repeat offenses or serious breaches, permanent closure of the Account may be ordered.
Article 14. Subcontracting
Arkada Studio may use subcontractors to provide the Services, in compliance with applicable regulations and, as regards personal data, with the requirements of the Privacy Policy.
Article 15. Force majeure
Arkada Studio cannot be held liable for any failure to perform or delay in performance due to an event of force majeure within the meaning of French law.
Article 16. Severability
If any provision of these Terms of Use is held to be void, the others remain in force. The provision deemed unwritten is replaced by a valid provision that comes as close as possible to the original intention.
Article 17. Applicable law and competent jurisdiction
These Terms of Use are governed by French law. Failing an amicable resolution, the courts with subject-matter jurisdiction in the Rouen district have jurisdiction.
The mandatory provisions of consumer law remain applicable. The consumer User is informed of the possibility of referring any dispute relating to the Services to a competent consumer mediator, in accordance with the terms set out in the Customer service / Mediation section of the Arkada Studio website.
Consumer mediation
In accordance with articles L.612-1 et seq. of the French Consumer Code (Code de la consommation), the consumer User may refer any dispute not resolved with Arkada Studio, free of charge, to the consumer mediator designated below:

– Audio recordings are not retained. The data is anonymized and not associated with the Account.
– Legal basis: the User's explicit consent when activating the microphone.
– Location & framework of voice processing. Processing is carried out in European regions where technically possible. If a provider operates from a region outside the EEA, appropriate safeguards (adequacy decision or Standard Contractual Clauses) are put in place. Details by platform are provided in the Privacy Policy.
Game Annex — SPARK RIDERS 3000

Game Annex — SALAMI (SIFFLARD)
1. Specific technical requirements

Internet connection required only in order to:

Download the application from the stores,

Create and activate the user account,

Scan the game box to identify the version (Standard or Deluxe) and download the associated resources.

After this step, all game features are available offline.
2. Internet connection

Internet use is limited to the first launch and to product activation.
Once the resources are installed, the game is fully usable offline, with no need for a permanent connection. -
Any updates to the application or to content may require an occasional connection.
3. Device hardware access

Camera: required to scan the game box during initial activation (or in the event of reinstallation).

No microphone access.
No use of voice recognition. -
Speakers or headphones recommended for the audio experience, but not required.
4. Activation mechanism and product link
-
The user creates an Arkada account by entering an email address and a password.
-
On first use, the user scans the Salami game box (Standard or Deluxe).
-
The application identifies the version and automatically unlocks the corresponding content.
-
No activation quota. Scanning the box serves to identify the version (Standard, Deluxe, Truffe) and to unlock the associated content. It may be repeated if necessary (for example reinstallation or change of device) without "consuming" an activation and without any limit on legitimate attempts.

Anti-fraud measures. In the event of abnormal or abusive use of the activation mechanisms, Arkada Studio may trigger checks and temporarily limit access to the Services (where relevant through suspension of the Account), in accordance with Articles 10 and 13.

The activated box is linked to the user account created.

In the event of reinstallation of the Application or a change of device, a new login to the Account and, where relevant, a new scan may be required to restore access to the content. Arkada Studio may implement anti-fraud measures (limiting the number of activations in quick succession, integrity checks) to prevent abusive activations.

Information related to product activation (Standard or Deluxe version). -
No collection of audio data, no voice recognition, and no continuous tracking of game sessions.

– Game saves are first stored locally, then synchronized with the Arkada API as soon as an Internet connection is available, in order to ensure that they persist.
– The data related to the Account (email, hashed password) and to box activation (Standard, Deluxe, Truffe version) is the only data collected.
– Arkada Studio may apply anti-fraud measures (for example temporary deactivation of an Account in the event of abusive use, with reactivation after verification by support).
